These terms describe your access to and use of the Austin Biotec, LLC website (www.austinbiotec.com) (the “Site”) and the information, and other content available on or through the Site. Please read these terms & conditions carefully before using the Site. We reserve the right, in our sole discretion, to change these terms & conditions at any time from time to time. Your continued use of the Site after such changes take effect will be deemed to constitute your acceptance of our terms and conditions as subsequently modified. If you do not agree to these terms, do not use this website and do not avail yourself of the services of Austin Biotec, LLC.

Austin Biotec, LLC is a medical tourism facilitator in the United States. We provide medical treatment and recovery packages for destinations in the United States and abroad. In this role, we research and gather publicly available information and provide this information to you for your personal use in making a more informed decision about your medical treatment options in or outside the US. The contents of the Austin Biotec, LLC website (www.austinbiotec.com), diagrams, pictures, images, videos, graphics text, or any other material referred to on the Site (“Content”) are for informational purposes only. We at Austin Biotec, LLC are not medical professionals and will not discuss or advise any you on issues relating to medical treatment. We are medical facilitators, putting you in contact with physicians or health care providers and provide information about their practice and credentials so that you may make an informed decision as to whether they and their treatments are suitable for you.

The Content on the Site, and information provided by Austin Biotec, LLC, is not intended to be a substitute for professional medical advice, diagnosis, evaluation or treatment. Austin Biotec, LLC does not provide medical advice or treatment, or endorse any specific medical provider or medical procedure. You and your physician or other qualified health care provider are solely responsible for evaluating the suitability for you of any medical treatment or health care provider mentioned on the Site or referred by Austin Biotec, LLC. In no event shall Austin Biotec, LLC, its directors, officers, members, employees, agents representatives, attorneys, predecessors successors, assigns, or licensors, its suppliers, or any third parties mentioned on the Site, be liable for any damages (including, without limitation, incidental and consequential damages, personal injury, wrongful death, lost wages, lost profits, or damages resulting from lost data or business interruption) resulting from the use of the Site or the Content. Austin Biotec, LLC, its licensors, its suppliers, or any third parties mentioned on the Site shall be liable only to the extent of actual damages incurred by you, not to exceed U.S. $500. Any claims arising in connection with your use of the Site or any Content must be brought within one (1) year of the date of the event giving rise to such action occurred. Remedies under these terms and conditions are exclusive and are limited to those expressly provided for in these terms and conditions.
You agree to defend, indemnify, and hold harmless Austin Biotec, LLC, its affiliates, and all respective directors, officers, members, employees, agents, representatives, attorneys, successors and assigns, from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable attorneys’ fees and litigation expenses), relating to or arising from (i) your use of this Site, any Site Materials, or services obtained on or through this Site, (ii) any arrangements you make based on information obtained on or through this Site, or (iii) any breach by you of these terms & conditions.
SUBMISSION OF USER PERSONAL INFORMATION
You agree to provide Austin Biotec, LLC with personal information, including medical information, relative to the treatment you seek. When you provide your personal information to us, we will provide it to third party healthcare providers or medical tourism providers who may be able to assist you or so that they can provide information to you about a medical procedure about which you inquired. Austin Biotec, LLC will also keep this information in our database to contact you at later dates. We use the information that we collect from you only to facilitate the selection of desired destinations, medical procedures and providers. We will not sell or share your information to any third party at any time without your permission. By providing any personal or medical information to Austin Biotec, LLC directly or on the site, you hereby agree that Austin Biotec, LLC may send that information to third parties, you hereby waive any liability towards Austin Biotec, LLC and you agree to indemnify Austin Biotec, LLC for any use of such information by Austin Biotec, LLC. You must be at least 18 years old to submit an information request or contact information to Austin Biotec, LLC.
TRAVEL ARRANGEMENTS
Austin Biotec, LLC may make travel arrangements for you for treatments provided, whether in the United States or abroad. You take full responsibility for assuring that such travel arrangements, including without limitation, hotels, airlines and other travel providers, are suitable for you prior to travel, and you hereby waive any liability towards Austin Biotec, LLC and you agree to indemnify Austin Biotec, LLC for any travel disruptions or irregularities arising from such travel arrangements. We recommend that you purchase comprehensive travel insurance for your travel. During the entire time of travel, you shall be in possession of a valid passport and a valid visa (if required) for the duration of your stay abroad.
PAYMENT AND CANCELLATION
You shall make payment directly to your physician or medical care provider on their terms. If you must cancel, your physician or other provider may charge a cancellation fee in an amount that they specify. You acknowledge that these fees are beyond the control of Austin Biotec, LLC and that we cannot alter them.
COMMISSIONS
You acknowledge and agree that Austin Biotec, LLC may take a commission from medical providers or travel providers for providing medical facilitation services under this agreement.
DISCLAIMER
TO THE FULLEST EXTENT PERMISSIBLE BY LAW, AUSTIN BIOTEC , LLC ASSUMES NO RESPONSIBILITY FOR, NOR DO WE MAKE ANY WARRANTY, EXPRESS OR IMPLIED, RELATING TO THE SERVICES, QUALIFICATIONS, SAFETY OR OF ANY PHYSICIAN, HEALTH CARE PROVIDER, HOSPITAL OR FACILITY, OR THE CONDITION OR SERVICE OF ANY TRANSPORTATION PROVIDER, AIRCRAFT OR OTHER VEHICLE, OR OF ANY HOTEL OR OTHER LODGING, OR OF ANY PRODUCT OR SERVICE ASSOCIATED WITH THE FOREGOING, PROVIDED TO YOU OR USED BY YOU, FOR YOU OR ON YOUR BEHALF. WE ARE NOT LIABLE FOR ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OF DUTY OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THERE FROM. AUSTIN BIOTEC, LLC DOES NOT GUARANTEE THAT TREATMENT YOU RECEIVE WILL RESULT IN ANY PARTICULAR OUTCOME.
DISPUTE RESOLUTION AND JURISDICTION
You expressly agree that all disputes arising out of or relating to this agreement or in any way relating to your use of the Site, including any claim involving Austin Biotec, LLC or its affiliates, subsidiaries, employees, contractors, officers, attorneys, directors, telecommunication providers, and content providers, shall be determined by binding arbitration in Chicago, Illinois, pursuant to the Streamlined Arbitration Rules of JAMS, a.k.a. the Judicial Arbitration and Mediation Services, under the laws of the State of New Mexico, without regard to conflict of laws principles. You expressly agree to personal jurisdiction and venue with regard to the above arbitration. The arbitrator’s award may be enforced in any court of competent jurisdiction.
ENTIRE AGREEMENT, SEVERABILITY, WAIVER
These Terms and Conditions, and a related (i) Client Informed Consent and Release and (ii) Client Agreement, constitute the entire agreement between you and Austin Biotec, LLC in respect to the use of the Site and its content, and the services provided. If any provision of these Terms and Conditions is found to be invalid, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
